Your privacy is of great importance to SmartSpotter B.V. (hereinafter referred to as SmartSpotter). We therefore adhere to the relevant privacy laws and regulations, including the General Data Protection Regulation (GDPR).

Our privacy and cookie statement in brief
We adhere to privacy legislation when processing personal data. This means that we:

  • Clearly document our purposes before we process your personal data, via this privacy and cookie statement.

  • Retain as little personal data as possible and only the data necessary for our purposes.

  • Request explicit permission for the processing of your personal data, if permission is required.

  • Take necessary security measures to protect your personal data. We also impose these obligations on parties that process personal data for us.

  • Respect your rights, such as the right to inspect, correct or delete your personal data that has been processed by us.

For what purposes do we use your personal data?
In this privacy and cookie statement, we explain what SmartSpotter does with the information we obtain from you. We obtain different types of personal data from you when you visit our website, www.smartspotter.com, when you use our services or the SmartSpotter app. For each purpose, we indicate which data we obtain from you, for what purpose we process this data and for how long it will be retained. We make a distinction between the data we process from Spotters that use the application, the data we process from business customers who use our services and general information. 1.    Spotter

Downloading the SmartSpotter app
To become a Spotter, you need to download the SmartSpotter app. You can do this via the App Store or Google Play. We have no influence on which personal data the provider (Apple or Google) processes and for what purpose. We therefore recommend reading the relevant privacy and cookie statements from the relevant provider.

Registering as a Spotter
If you wish to use the SmartSpotter app, you must first register as a Spotter. You can register via the app or the website. We will then create an account for you, on which you can log in with your e-mail address and password of your choice (performance of the agreement).

To that end, we process the following personal details:

  • Country

  • Postcode (optional with waiting list)

  • E-mail address

We retain your personal data for up to 3 months after you cancel your account, or up to 6 months after you last logged in to your account. In those cases, we assume you no longer wish to use our services. We keep this information so you do not have to enter it again and again and so we can approach you more easily if necessary.

Your profile
After you have registered as a Spotter, you can log in to your account on the website and in the app. You can add information to your profile within your account. Without completing your profile, you can carry out paid assignments, but not yet request payment (performance of the agreement).

To that end, we process the following personal details:

  • Account information

  • Name and address details

  • Profile picture

  • Gender

  • Date of birth

  • Telephone number

  • E-mail address

  • Payment details

  • Registration date

  • Availability car (only for PRO Spotters)

We retain your personal data for up to 3 months after you cancel your account, or up to 6 months after you last logged in to your account. In those cases, we assume you no longer wish to use your account. We keep this information so you do not have to enter it again and again and so we can approach you more easily if necessary.

Using the SmartSpotter app
If you are logged in, you can carry out paid assignments in the application (performance of the agreement). Moreover, you can nominate new Spotters and you can see how well you are doing compared to other Spotters (ranking). You can also view the Spotters top 3 (legitimate interest). We would like to encourage our Spotters to keep conducting spots.

To that end, we process the following personal details:

  • Profile details

  • Location details

The following personal data is visible to other Spotters in the ranking:

  • Profile picture

  • First name

  • Your position within the ranking

We retain your personal data for up to 3 months after you cancel your account, or up to 6 months after you last logged in to your account. In those cases, we assume you no longer wish to use your account. We keep this information so you do not have to enter it again and again and so we can approach you more easily if necessary.

We only process your location data on the basis of your consent. You can withdraw your consent at any time by adjusting your preferences in the app settings.

Sending notifications
When you use our app, you can choose to receive notifications from us. For example, you can receive a notification if a new assignment is available or if an assignment that has already been carried out has been approved or rejected. This notification will then appear on your device (consent).

To that end, we process the following personal details:

  • Unique user ID

  • Location details

We keep this information until you withdraw your consent. You can withdraw your consent at any time by adjusting your preferences in the app settings.  

2.    Business customers

Providing our services
As an organization, you can use our services to quickly gain insight into in-store execution. To do so, you get access to the SmartSpotter dashboard (performance of the agreement).

To that end, we process the following personal details:

  • (Company) name

  • (Business) e-mail address

  • (Business) telephone number

  • Name and position of the contact person

  • Invoice details

  • Payment details

We keep this information for the term of the agreement. We keep some data longer if we are legally obliged to do so (for example, on account of the fiscal retention obligation).

3.    General/Website

Contact
When you approach us via the contact form, send an e-mail message, contact us by telephone or in any other way, you accept our offer to contact us. You can also request a demo via the contact form (performance of the agreement).

To that end, we process the following personal details:

  • Name

  • (Business) e-mail address

  • Telephone number

  • Any information you enter yourself as the content of a message

We keep this information for as long as is necessary for this contact, because we want to be sure we have dealt with your question or complaint properly. 

Logging in via the website
Via the website, you can log in to your account as a Spotter, a user of the SmartSpotter TEAM app and a customer (performance of the agreement).

To that end, we process the following personal details:

  • E-mail address

  • Self-chosen password

We retain this personal data for up to 3 months after you cancel your account, or up to 6 months after you last logged in to your account. In those cases, we assume you no longer wish to use your account. We keep this information so you do not have to enter it again and again and so we can approach you more easily if necessary. Customers are responsible for the management of users of the SmartSpotter TEAM app and other company and personal data.

Experiences
We post customer experiences with SmartSpotter on our website. We will only share your experience with SmartSpotter with your explicit consent (consent).

To that end, we process the following personal details:

  • Company name

  • Name

  • Position

  • Content of the shared experience

We keep this information until you withdraw your consent. You can withdraw your consent at any time by contacting us using the contact details at the bottom of this privacy and cookie statement.

Newsletter
You can sign up for our newsletter via our website. In this newsletter, we inform you monthly by e-mail about all the news regarding SmartSpotter. Your e-mail address will only be added to our list with your explicit consent (consent).

To that end, we process the following personal details:

  • Name

  • Language

  • Country

  • E-mail address

We keep your personal data until you unsubscribe from the newsletter. You can unsubscribe from the newsletter at any time. Every newsletter contains a link to unsubscribe.

Job applications
Did you respond to one of our vacancies or submitted an unsolicited application? In that case, we process your data to be able to process your application and to prepare for the possible conclusion of an employment contract (performance of the agreement).  

To that end, we process the following personal data:

  • Name and address details

  • Contact details (e-mail address and telephone number)

  • CV

  • Motivation letter

  • Salary indication

  • References

  • Any other information you send with your application  

We keep your application data for a maximum of 6 weeks after the position has been filled. We keep this data so we can contact you in case the position becomes vacant again within the probationary period. If we cannot offer you a position at the time, we can - with your consent - keep the application data for another year. You can withdraw your consent at any time by sending us an e-mail.

A social media and Internet screening may form part of the application procedure. This is necessary to ensure our image is maintained when hiring new staff. We do this on the basis of our legitimate interest. We will look for your name on Google and any profile on various social media. This, of course, insofar as these profiles are public; we will not ask you to provide us with access to a restricted social media page or to establish a connection with us. The results of the screening will be discussed with you. If you object to this, you can indicate this by e-mail when you apply.  

hCAPTCHA
We use the hCAPTCHA service of Intuition Machines, Inc. to protect our website against spam and misuse. For hCAPTCHA to work, the IP address of a website visitor, mouse movements and possibly other data are collected. To that end, this information is sent to and processed by Intuition Machines, Inc. By analysing this information, Intuition Machines, Inc. can determine whether we are dealing with a real website visitor or a robot. When can we share your personal data with third parties?
SmartSpotter only shares your personal data with third parties if this is permitted under current legislation. We may provide your personal data to third parties because:

  • we have engaged them to process certain data;

  • it is necessary to perform the agreement with you;

  • you give consent for this;

  • we have a legitimate interest in this;

  • we are obliged to do so by law (for example, if the police require this when a crime is suspected).

The parties that process personal data in our or your assignment are:

  • IT suppliers and service providers

  • Cookie service providers

  • Payment service providers

  • Marketing agencies

  • Partners

To be able to provide our services, SmartSpotter may disclose your personal data to parties located outside the European Economic Area (EEA). SmartSpotter will only do this if there is an appropriate level of protection for the processing of personal data. This means, for example, that we use a model agreement from the European Commission or make agreements about the handling of personal data.

Social media buttons
We use social media buttons on our website, which redirect you to the social media platforms. This gives you the option to follow us and to share content within the network. You will also encounter advertisements on your social media page. The buttons work because of pieces of code that come from the social media networks. Cookies
On our website and in the app, we use cookies and similar techniques, such as pixels (hereinafter referred to as cookies) from ourselves and third parties. Cookies are data files that can be automatically stored on or read from the device (such as a PC, tablet or smartphone) of the website visitor or app user when visiting a website or using an app. This is done via the web browser on the device. We and third parties use cookies to:

  • Enable functionalities of the website and app (technical and functional cookies)

  • Analyse the use of the website and the app and make the website more user friendly on that basis (analytical cookies)

  • Display personalised advertisements (marketing cookies)

These cookies collect the following information from you:

  • IP address

  • Cookie ID

  • Website and click behaviour

  • Referrer URL

When you visit our website for the first time or use our app for the first time, we show a notification with an explanation about cookies. Insofar as we are obliged to do so, we will ask for your consent to the use of cookies.

Deleting cookies

Most cookies have an expiry date. If an expiry date is set, the cookie is automatically deleted when that expiry date passes. You can also choose to manually delete the cookies before the expiry date has passed. Consult the manual of your browser.

Is your personal data secured?
We take appropriate technical and organisational measures with regard to the personal data to be processed, aimed at preventing the loss thereof or any form of unlawful processing (such as the unauthorised disclosure, impairment, change or provision of personal data).

What are your privacy rights?
You have the following rights:

  • The right of access: You have the right to view the personal data we process about you.  

  • The right to rectification: You have the right to correct or supplement the personal data we process about you, if it is incorrect or incomplete.  

  • The right to object: You can object to the processing of your personal data and to direct marketing.  

  • The right to erasure: You can ask us to erase your personal data.

  • The right to withdraw your consent: if you have given us consent to process personal data, you can withdraw this consent at any time.

  • The right to data portability: if it is technically possible, you have the right to have the personal data we process about you transferred to a third party.  

  • The right to restriction of processing: in some cases, you can ask us to limit the processing of your personal data (whether or not temporarily).

We may ask you to identify yourself when you make your request. To that end, we request data to ensure you are the right person to whom the personal data belongs.

In principle, we will comply with your request within one month. However, this period can be extended by two months for reasons related to the specific privacy rights or the complexity of the request. If we extend this period, we will notify you in good time.

Changes to this privacy and cookie statement
When our website changes, we must of course also adjust the privacy and cookie statement. Therefore, you always have to check the date above and check for new versions on a regular basis. We will do our best to notify you of any changes.

Questions or submitting a complaint
If you have any questions or want to submit a complaint about the use of your personal data, you can contact us using the contact details at the bottom of this privacy and cookie statement. We handle every question and complaint internally and communicate this further with you. If you feel our service falls short of your expectations, you are entitled to submit a complaint to the supervisory body. This is the Dutch Data Protection Authority.
